Council OKs zoning changes for apartments

The owners of Eagle Landing Apartments on the corner of East Davis and Louisiana Ct. in Fayette were cleared to build a new complex by the Fayette city council during its most recent meeting on Tuesday, August 23.

Prior to the council meeting, the city’s Planning and Zoning Committee held a public hearing on the matter on Monday, August 15. The committee approved a request by Marty and Debbie Shaw, owners of Mos Investments, to rezone a lot located at 400 East Davis Street from C (Conservation) to RS-3 (Residential Multiplex).

During the council meeting the following week, Alderpersons gave unanimous approval to grant the zoning request.

The Shaws plan to construct a new two-story building that will have four three-bedroom units intended to house up to 12 university students. It will have a similar appearance as the current three-story Eagle Landing Apartments that were built in 2015.

When Mr. and Mrs. Shaw initially met with the council on Tuesday, July 26, they also asked that the city vacate a strip of land that is currently owned by the city beside where the new building will be constructed and inquired as to whether they could obtain the land to use as parking for the new apartment building.

The strip of land in question does have below it a portion  of the city’s sewer system and a drain.

“Us being able to acquire that extra footage will determine the size of the building,” said Mr. Shaw. 

Nathan Nickolaus, the city’s attorney, explained that the city could vacate the strip, at which time the land would revert to the owners on either side of it. One of those owners would be Mos Investments. Landowners on the other side would automatically be granted the other half.

The city did not address the strip of land in question during its August 23 meeting, but will likely take up the matter at its next meeting on Tuesday, September 12.

The council also gave unanimous approval the Planning and Zoning Committee’s approval of a zoning change request by Mason Spurgeon. Spurgeon owns lots 310, 314, and 322 on South Church Street and intends to build apartments there. He requested the zoning be changed on that land from B-4 (Business) to RS-3 (Residential).

The city council meets regularly on the second and fourth Tuesday of every month at 6 p.m. in City Hall. The next regular meeting is scheduled for Tuesday, September 13. Meetings are open and the public is invited.
